We’ve recently made updates to our HR Policies and Procedures Manuals, including the Employee Induction Kit, NDIS Self Managers Direct Employment, and NDIS Support Worker Agency manuals.
These updates reflect changes arising from the Fair Work Legislation Amendment (Closing Loopholes) Act 2023 and the Protecting Workers Entitlements Act. Key changes relate to wage theft, deductions, workplace delegates and Fixed Term Contract Information Statements.

HR Policies – New Policies
- Before Engaging Employees – Intentional Wage Theft. Added a new section that intentional wage theft or non-payment of superannuation will be criminalised from 1 January 2025. A Voluntary Small Business Wage Compliance Code is currently being established the Fair Work Ombudsman. Compliance with the Voluntary Code will mean a small business won’t be prosecuted if they underpay their employees. We will provide updates once the code has been released.
- Chapter 2 – Conditions of Employment – Deductions. There are new rules arising from the Protecting Worker Entitlements Act that changed what can be deducted from an employee’s pay (with or without their consent). A new section has been added relating to deductions, but all employers are recommended to read and comply with the new provisions https://www.fairwork.gov.au/pay-and-wages/deductions-and-related-issues/deducting-pay
- Chapter 2 – Conditions of Employment – Trade Union Membership. A new section has been added relating to trade union membership and workplace delegates as a result of the Closing the Loopholes Act. New protections have been added for workplace delegates and employers need to be aware that breaches will attract penalties.
- Chapter 5 – Safety and Security – Domestic and Family Violence. Added a new section called Additional Support, referring people to the national domestic, family, and sexual violence counselling, information, and support service – 1800RESPECT.

- Before Engaging Employees – National Employment Standards. Updated to include Superannuation Contributions.
- Before Engaging Employees – Industrial Awards or Agreements Added reference to the Fixed Term Contract Information Statement and included a link to download the statement.
- Chapter 1 – Recruitment and Selection – Induction. Removed reference to date of commencement for the Fixed Term Contract Information Statement and included a link to download the statement.
- Chapter 2 – Conditions of Employment – Records for Employees. Added deductions into the list of records to be kept.
- Chapter 5 – Safety and Security – Domestic and Family Violence. Added a new paragraph in the introductory section highlighting it is unlawful to take adverse action against an employee or potential employee because they have or has been experiencing family and domestic violence. Removed transitional arrangements for unpaid leave and removed reference to the effective date in the Paid leave section.
- Minor grammar changes – Updated all references to unions to become trade unions, removed references to dates prior to this update.
